I was fired from my last job. How and when do I disclose this in interviews?

Q: I've worked for mid- to large-sized banks for almost 20 years. What do I say to potential employers about being fired unfairly and my fight to have that overturned? (I have retained an attorney.) Now I am considering applying to a new bank for employment, but I'm not sure how to address this when it comes up. Do you have some guidelines for how these situations should be handled? I am so concerned about coming across to a new employer as a poor prospect. I've had many people tell me I should not even mention this unless directly asked, but I don't want to seem dishonest.

Kristen says: It is commendable that you want to honest. However, there is no need to bring up your termination unless a potential employer does. When a new employer verifies employment, they may ask confirmation of the dates of employment and whether or not you are eligible to be rehired. On an application, you may check the box that asks if it is okay to contact your previous employer as “no.” Just make sure to list plenty of professional references you worked with at that employer who will speak highly of your work and work ethic. I would save any potential disclosure for when you have an offer on the table, pending reference checks. At that time, it is appropriate to discuss the situation with your recruiter, but I would not advocate doing it before then, and certainly not proactively. Your attorney should be very familiar with employment law and can advise you as well.
